    This seems like he's just just referring to Harry Potter fanfiction in general which Rowling, unlike RR Martin, has no problem with.

    This could literally just be him calling up the agency and asking "Hey, is it okay if I write some fanfiction online about the Harry Potter series?". More than likely, he "Forgot" to mention the "Donate" feature on his website.

    I'm not saying the agency aren't aware of it; just that going after him simply isn't worth the effort.
