    Exactly as it sounds like. You buy an official Portkey from the Ministry or a licensed company. Keep in mind that the Department of Transportation has a Portkey office -- I wouldn't be at all surprised if Portkeys were regulated, and Dumbledore casually broke the law whenever he made one, because he's cool like that.

    @Sesc:

    I don't think they can actually regulate that in any way whatsoever let alone know when someone made one, provided they aren't in their direct physical vicinity. Otherwise they might have known about the Triwizard Cup being turned into one in the first place.

    Same goes for Apparition. Why do they need a license exactly?

    Odran, I didn't say anything about being able to track that. I talked about there being a rule to that effect, as a response of your question why one might be able to buy Portkeys.

    Portkeys are regulated and you need a permission. It's not far-fetched to assume the legal way to get one is to apply and pay for one from the Ministry. That you can break the rule and do whatever is true for any rule and besides the point.

    Edit: And there was a Canon scene about the license to Apparate.

    And I assume it's the same with Portkeys. You try it, you get caught, you pay a fine. Just like with any other rule.

    (Well, except if you are Dumbledore :D)

    Because it makes them money. Why else?

    There's a ton of stuff that's "regulated" and yet, is completely up to the person to be honest about it in the real world: remodels, above-ground pools, rewiring, paying taxes on private sales, paying taxes on lotto/gambling winnings under a certain amount, etc. etc.

    Regulations and the ability to enforce regulations are two very different things. However, if the Ministry can track magic being done anywhere in the country by a school-aged wizard or witch, then they can track an unregulated Portkey.

    The books are not with me and I don't have ebooks, so a quick question: after Hagrid took Harry to Diagon I'm assuming the Dursleys immediately went back to Little Whinging, right? I mean as soon as they somehow got ashore, because I think Hagrid took the boat, yes?

    It's not said, because there is a time-skip. The Diagon Alley chapter ends with Harry in the train back to Little Whinging (I presume? It's not said), and the next starts with "Harry’s last month with the Dursleys wasn’t fun."

    You might infer that if Harry spent the whole day at Diagon Alley ("The late afternoon sun hung low in the sky ...") and returned back home at (early) evening, that the Dursleys had to be there by then -- otherwise Harry would've been standing in front of the empty house.

    On the topic of Portkeys, presumably the spell isn't something the Ministry allows to be published. That would be the easiest way to restrict their use.

    I was going to say "good luck suppressing the information", but then remembered that this is the Harry Potter universe, where magical offense is stronger than magical defense, and it is in fact plausible that they would be able to (magically, not in terms of competence).

    Well, clearly there are leaks, as Dumbledore knows the spell and has never worked for the Ministry. But he's a rather well-connected fellow. I imagine the average wizard on the street has less access to restricted information.

    Not to mention that non-verbal magic makes it harder for people to learn the spell by watching it being performed.
