    The actual correct answer is the one Xandrel gave. In HP, the Minister is just one step short of god (almost).

    That is to say: Certainly there are rights. See e.g. in the court scene in OotP, where Dumbledore cites some. But the impression I always had is that it's a knowledge-is-power thing, and that furthermore, you should do away with notion of strict "laws" as we know them. Think rather lots of rules, sometimes contradicting, that have been created in the past and can be cited as a precedence -- and a court that's more like a thing-meeting, which evaluates them, and then gives a verdict.

    So if Dumbledore wouldn't have explicitly brought up Clause 7 -- "Magic may be used in a life or death situation" -- of the Decree for the Reasonable Restriction of Underage Sorcery (note that it's a decree, i.e. another one of those the Minister just can draw up when he feels like it), then it wouldn't have been considered, even if Harry had said "I defended my life".

    The point being; there are rights, as long as you know of them, but additionally, the Minister can override basically all of them, and then you have to prove he was wrong in doing so -- and as long as you don't do that, he has the right to do it. Which, naturally, is kinda hard if he just ordered to have you Kissed. If you're innocent as Sirius was, your best bet would be to argue out of hiding until you got the assurance of a full trial.

    In the particular case of Barty, however, don't forget he already had his trial, and had been convicted -- and broke out of prison again. Kissing him on sight is not unreasonable (leaving aside, of course, that Fudge was particularly keen on that to silence him).


    And I'm not even going to respond to the rest of the debates. Why the fuck do we have a recent Moody thread, and it's still being talked about in here?

    If the Minister is basically a dictator, then why the hell was Voldemort trying to overthrow a regime instead of trying to be elected (do we know exactly just how Minister is chosen) ?

    Would it be incorrect to say that Voldemort certainly achieved more in almost one year of being a puppeteer of a puppet Ministry than in more than (5/10 ?) years of violent terrorism ?

    We don't know exactly how a Minister is chosen. In the old Daily Prophets, there is a campaign slogan mentioned, but the DPs aren't too reliable. In HBP, Scrimgeour is "appointed" and "succeeds" Fudge, who was forced to resign due to public opinion, but the former might have been a consequence of the latter, and not the usual way to chose Ministers.

    And I would certainly say that Voldemort was far more successful the second time around. He learned from his mistakes, and changed the system from within, instead from without.

    Was Sirius the only one sent to Azkaban without a trial? Besides Hagrid.

    I mean, most of the Death Eaters that were in Azkaban seem to have gotten trials, or at least Bellatrix did. What made Crouch toss Sirius into Azkaban without one?

    It was, I think, the same day Voldemort died. Now, you would think that would be a positive thing, and make throwing him in azkaban immediately without a trial less urgent. However, VOldemort was brought down with absolutely no interaction from the ministry that has failed to bring him down for years. A child did what supposedly well trained aurors repeatedly failed to do. So while the magical world rejoices, the ministry looks incopetent. Throwing a murderer death eater in prison who appears vaguely related to the incident is a fast way to both boost public opinion, and appear relevant.

    What is the way to end a fidelius charm? Not breaking it or finding away around it, but "we're done with this now and we don't need it anymore".

    It's not widespread because it's obscure as fuck. Pretty sure either Dumbledore or Lily found it and dusted it off to hide the Potters.

    Obscurity is not a cause it's a side effect. So it can be rephrased: Perhaps the spell was never used and fell into obscurity because there is no way to dispel it.

    The Fidelus Charm isn't a spell everyone and their grandmother were throwing up during the war. Beyond being basically unknown, it was also extremely difficult to cast. Fanon has inflated the perception of it being a go to charm for protection. The inability to dispel it is speculation, so it's authors choice as to where you stand on it.

    Besides, I find it extremely unlikely that what magic has done, it cannot undo, the sole exception being damage to the human body.

    If you're referring to here on the forums (which would make this not exactly the right place to ask it, but whatever), it usually differs based on who banned the person: red is Midknight, cyan is Vash, pink is Sree, etc. Black typically signifies temporary bans.

    In book 4 at the World Cup the Ministry has a muggle collecting money for them. Was there an explanation for this, or was this just poor planning on their part? Why not have a wizard collect money who understood what was going on?
    Should this be in the HP plot hole section of DLP?

    The explanation is that he is not collecting money for them.

    It was his site. The wizards are camping on a Muggle camping site and paying in Muggle money, so he likely will keep it.

    Now you might ask why they didn't pick a random field and created their own site, staffed with wizards, but that's a different question.
