Why the hell would protections on the house do it? I thought those were to keep Voldemort and the like out not to keep Vernon from assaulting Harry, it's his house for God's sake. I mean the protections didn't keep his from locking harry in a cupboard, that's pretty close to abuse...

Would Harry be punished for his accidental magic in PoA if he was not BWL and because of the whole Sirius business?

Are the outbursts of accidental magic punished in any way ? (They could be deadly IMO)

Don't see how they could punish something accidental. If it is fatal though it'd be manslaughter instead of murder. Probably even less than that because there was nothing you could actually do to prevent it.

No, that would mean that Harry's magic protected him when he was choked, for whatever reason, in that specific instance. Just because A causes B, that does not mean A causes C, D E, etc. etc.

Saying that that happens every time a wizard without a wand is in danger, no matter his/her age, is spectacularly foolish, as there simply isn't enough data.

Anyway, it seems like you think that a wizard's magic is sentient, and that in extreme cases of danger, it will consciously protect its host. I don't believe that is the case.

I think it's much more likely that when a wizard is in an extreme state of stress (either in body or mind), the magic reacts to the wizard's needs. A good example is when Harry was running away from Dudley and his gang and somehow found himself on the roof. Harry was most likely scared shitless at that particular moment. He needed to get away or he was going to get the crap kicked out of him, and he would also probably get blamed for inciting Dudley or something like that, and receive a severe berating from Vernon, at the least.

Thus, he was in an extreme state of stress and he subconsciously called on his magic to get away, even though he didn't know of its existence.
