Okay...I was on FicWad a little while ago, and I saw this, something that pissed me off considerably.

Now, if any of you have read Chimera, Chapter 5 or 6 features a VERY similar scene, and I'm pretty sure I was the first to write a scene where Harry actually challenges the Goblin in charge of his vaults to a fight.

So...what should I do? D'you think its different enough that I should just let it go, or d'you think I should report it, or something?

By the way, the author Brazilianpimp is apparently a member of DLP.

I've read Chimera, and after reading this, I suggest you report it. I don't think it is different enough to say that it was "original."

It is plainly plagiarised and horribly written, his other story "Harry Potter and the Dark God" Is even worse, so maybe you should be slightly thankful that whilst he did plagiarise your story he at least did it in a semi-legible way.

Nail his ass to the wall, mainly because he bit from a terriffic scene from Chimera, and mangled it into something that shouldn't see the light of fucking day.

It's common knowledge that we're all going to have similar idea's in some way shape or form, some of us might even impliment then in similar fashions. But this is like a blatant ripoff with nothing more then two name changes. I have yet to really see more then 3 stories showing the goblins into bloodshed. (And only one that was written in such a fashion -Chimera-).

Can you get arrested for plagiarizing fanfiction? I mean, don't you, as the author, waive all rights to the story in the disclaimer you're supposed to put at the beginning?

Yeah this is pretty messed up, though. Its like someone cheating off of you on a test you studied very hard on.

 

No, you can't get arrested, since it isn't my intellectual property (HP doesn't belong to us...).

But its the principle of the matter, since originality is something that is pretty valuable in the fandom, considering the number of cliches that exist.

Oh, and report it. Chimera is one of my favorite stories in the HP fandom and this garbled trash makes me sick. How can anybody take such a good scene from a fic like Chimera and turn it into that.

Anyways, yes definatly report it.

 

First get him to explain before you report his ass and ruin his stories. He has one where he didn't plagiarize. If he explains why, and deletes that story or does a rewrite, don't report him. Give him a chance first.

 

Agreed, if he has a believable reason as to why he did the scene that way, (If you can even call it a scene, it was more of a pile of shit if you ask me) and didn't steal the scene, then give him a chance to go back and change it.

On the other hand, if he did steal it, or has a shitty excuse, do as Thalrian says, "Nail his ass to the wall" if he doesn't have the skill to come up with his own stuff; or in the least at least ask to use your idea, he should burn in hell!

 

Well, that was truly terrible utilization of your idea. I wouldn't mind seeing it gone. But I don't think there's enough material there to have it banned.

For something to be considered plagiarism, I'm pretty sure it has to contain directly coppied passages, names and concepts from the original material. As far as I've seen (and correct me if I'm wrong), what this guy took from you is the basic idea behind Harry challenging the goblin that had wronged him and the idea behind meele fight. That is NOT enough to call it a plagiarism.

If he, for example, took the name of the rite or name of the goblins involved or the setting (the king, arena...) or even merely coppied your weapons and action sequence, you could do something. Like this, his copy is only slightly worse then all the coppies of Rosswrock's trunk or "Griphook remembers!" scene.

The best you could do IMO, is to have him remove the scene, or at least acknowledge the source. You can report it to FFN, but I'm not sure what will come out of it.

 

I'd say always, confront him and contact him first. Find out how intentional it was, make him correct it, etc...

Unless it's blatantly obvious copy and paste, I'd say confront first.

It feels like a great many "plagiarists" are idiot teenage kids not really understanding that what they did may constitute plagiarism. Fanfiction's practically built on taking known ideas and altering them slightly into your own version of a story.

I mean, theoretically he could simply be writing a fanfiction of your fanfiction, not one of JKR's Harry Potter. Crappier than the original, sure, but I'm not convinced you'd have any legal right to prevent him from doing so.

If he doesn't respond to your problems, if he doesn't change it enough for you, or he ignores you, then absolutely, completely report him.

Yeah, I probably won't do a thing about it, really. As soon as I saw it yesterday, though, I sent the kid a review on FicWad.

So, there you have it. I guess what I'm more irritated about is the fact that an original scene like that had to be taken by a shitty author and put in a shitty story. I mean, if a really good author took that scene and wrote it into a really good fic, I'd be flattered even without getting any credit.

Yeh...happened again, different story (of mine) and different author.

The Harry/Narcissa scene with Draco forced to watch from Incubus...but the guy who plagiarized it put in a different, disgusting end to the scene, though the meat of it is still extremely similar.
